Public Hearing – Parking Ordinance

The City of Lincoln Public Hearing – Parking Ordinance met in the Council Chambers on Monday, October 3, 2016.

City Clerk Mrs. Gehlbach called the roll call. There were seven Aldermen present (Alderman Bauer, Alderman Hoefle, Alderman Hoinacki, Alderman Horn, Alderman Mourning, Alderman Tibbs and Alderman Welch) and one absent (Alderman Parrott). Also present were Street Superintendent Mr. Landers, Police Chief Adams, Building and Safety Officer Mr. Lebegue, American Water Manager Mr. Ferguson and Fire Chief Miller. Also present were Mayor Neitzel, City Treasurer Mr. Conzo, City Attorney Mr. Blinn Bates, City Administrator Mr. Johnson, City Clerk Mrs. Gehlbach, and Recording Secretary Mrs. Riggs.

Mayor Neitzel called the meeting to order at 7:00 p.m. on the Parking Ordinance.

The City Council of the City of Lincoln is considering amendments to the following City Code Sections: Section 9-5-10, Parking to Obstruct Prohibited, Section 11-2-1, Definitions, Yard Front and Section 11-4-2, Uses Permitted, All Residence Districts pertaining to the provisions for the parking, motor vehicles, trailers, campers, recreational vehicles, trailers, campers, recreational vehicles, boats and other personal property within the City limits of the City of Lincoln.

Mr. Richard Sinks said he has a small lot and he wants to know what the problem is and how this will affect his property. Alderman Bauer said that Alderman Parrott requested this be revisited. Alderman Tibbs said that she did not have a problem with Mr. Sinks trailer. Mr. Sinks said he is in a unique situation and his truck sticks out.

Alderman Bauer said the City Council can’t go back seven years and that she did not have any right to tell him what he can do with a trailer. She said they could leave it alone.

Mr. Sinks said he wanted to hear any suggestions. Alderman Welch asked Building and Safety Officer Mr. Lebegue what his thoughts were on this. Building and Safety Officer Mr. Lebegue said they either go through with this direction or have not found any city that had public street parking. Mr. Sinks said his trailer is not on the street. Alderman Bauer said that there is no one size fits all for this situation.   Alderman Mourning said the problem in his area has to do with them parking long trailers. Alderman Tibbs said there is nothing on the books and wondered how the City was going to know how long a trailer sits there and that it is dangerous. Mr. Lebegue said he gets calls from citizens letting the Building and Safety Office know that they are going to be unloading for a day or two and that is not a problem. Alderman Hoefle said that it seems the problem is the flatbed trailers that don’t have reflectors on them. Alderman Hoinacki said it is the large campers and the neighbors can’t see when they are trying to back out of driveways. Alderman Welch said there are people that get the notice and they move the vehicle and start the 72 hour clock again.

Mayor Neitzel closed the hearing at 7:27 p.m.
